Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of phoenixsubliminal.com (the “Site”) and any products you purchase from us. By creating an account, placing an order, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site. We are Phoenix Subliminals (“we,” “us,” “our”). Accounts
You must provide accurate information when creating an account and keep it up to date. You’re responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each customer may maintain only one account; see “Prohibited conduct” below regarding duplicate accounts.
Orders and payment
All prices are listed in U.S. dollars. Payments are processed securely through Stripe. By placing an order, you represent that you’re authorized to use the payment method provided. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud or abuse.
Digital products and license
Our products are digital audio files, including personalized tracks built to your selected preferences. When you purchase a product, we grant you a limited, non-exclusive, non-transferable license to download and use the audio for your personal, non-commercial use only.
You may not resell, redistribute, publicly perform, broadcast, upload, share, or create derivative works from any audio file or other content you purchase or access through the Site, in whole or in part, without our prior written permission. All audio content, recordings, and site content remain our property or that of our licensors.
Refund policy
We offer a 30-day money-back guarantee on purchases. If you’re not satisfied, contact us at [email protected] within 30 days of your purchase date to request a refund. Once a refund is issued, your access to download the associated product will be revoked.
Refund abuse
Our refund policy is intended to be fair to genuine customers, not to be used as a way to repeatedly obtain and return products for free. If we determine, in our reasonable discretion, that an account has engaged in refund abuse — including repeated refund requests, chargebacks, or payment disputes filed in place of contacting us directly — we may:
- Deny the refund request
- Ban the account and disable it permanently
- Prohibit the individual from making future purchases on the Site
Prohibited conduct
In addition to the restrictions above, you agree not to:
- Create a new or alternate account to evade a ban, suspension, or purchase restriction placed on you or a prior account. Any account found to be created for this purpose will be terminated immediately and forfeits any pending refund, credit, or order without compensation.
- Use a stolen, fraudulent, or unauthorized payment method
- Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Site or its systems
- Use the Site or its products for any unlawful purpose
Sharing of abuse information
If an account is banned for repeated refund abuse, fraud, or evasion of a prior ban through a duplicate account, we may, as a courtesy to other businesses in the subliminal audio industry, share relevant account information with other subliminal audio producers to help them identify and prevent similar abuse of their own stores. This is separate from, and in addition to, any information we may share with our payment processor or fraud-prevention services in the ordinary course of business.
Results and health disclaimer
Our products are intended for personal development and entertainment purposes. We do not guarantee any specific outcome or result from using them, and individual experiences will vary. Our products are not a substitute for professional medical, psychological, or mental health advice, diagnosis, or treatment. If you have a medical or mental health condition, consult a qualified healthcare provider before use.
Intellectual property
The Site, including its design, text, graphics, logos, and audio content, is owned by Phoenix Subliminals or its licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you beyond the limited license described above.
Limitation of liability
To the fullest extent permitted by law, Phoenix Subliminals will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to your purchase will not exceed the amount you paid for the product giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles, and any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Washington State.
Changes to these terms
We may update these Terms from time to time. We’ll post any changes on this page and update the effective date above. Continued use of the Site after changes take effect means you accept the updated Terms.
Missed-Call Text-Back Program
If you call our published phone number, (817) 497-8274, and we’re unable to answer, you consent to receive one automated SMS text message from us at the number you called from, letting you know we saw your call and will follow up. Message frequency: up to one message per missed call. Message and data rates may apply. Reply STOP at any time to opt out of future messages, or HELP for assistance. Consent to receive these messages is not a condition of any purchase. This SMS program is separate from our marketing email list described in our Privacy Policy.
